48. Penalty for contravention of section 6 or section 30.- Whoever contravenes the provisions of clause (b) of section 6 .[1] [or section 31, sub-section (2) of section 37] shall, on conviction, be punished with imprisonment for a term which may extend to six months or with fine which may extend to five hundred rupees, or with both; and in the case of a continuing contravention, with a further fine which may in case of contravention of clause (b) of section 6 extend to one hundred rupees and in the case of .[2][contravention of section 31 or sub-section (2) of section 37] to fifty rupees per day during which the contravention is continued after the first conviction;
Provided that in absence of special and adequate reasons to the contrary mentioned in the judgment of the court the punishment for the second or any subsequent offence shall not be less than imprisonment for a term of three months and a fine of five hundred rupees.
49. Penalty for contravention of other sections.- (1) Whoever in contravention of the provisions of section 35 makes or recovers any unauthorized trade allowance shall on conviction, be punished with imprisonment which may extend to three months, or with fine which may extend to two hundred rupees or with both and in case of subsequent contravention with imprisonment which may extend to six months or with fine which may extend to five hundred rupees with or with both.
